As the terms of this Agreement may be modified at HERBOLARIUM sole discretion, without any obligation to notify you, we advise that from time to time you check this webpage to review the changes. Your continued use of this webpage shall constitute your consent to any changes.

Notwithstanding the above, you may access this website and make a single copy of the material for your personal, non-commercial use. Nothing in this Agreement shall be construed as granting you a license for anything other than your personal use.

This website may contain links to other webpages that are operated by third parties, some are under the control of HERBOLARIUM and some are not. HERBOLARIUM is not responsible for, and expressly excludes all liability with relation to these linked websites which you access at your own risk, and HERBOLARIUM makes no representations, warranties or conditions concerning the linked webpages or their contents.

Orders and Payment: In the event that your order is cancelled or refused, you shall receive an email confirmation stating same. Additionally, if your order is refused or cancelled following payment, HERBOLARIUIM will reimburse you for the full amount paid. Please note that all discounted items are final sale.

The third party credit card service provider must approve all purchases made through the use of a credit card. 

You agree not to resell any products purchased under this Agreement, nor to transfer any of your rights hereunder without the prior written consent of HERBOLARIUM

d) Shipping

HERBOLARIUM will ship based on the method you select from the available options. The estimated time of the arrival of your product should be considered as an estimate only, and HERBOLARIUM will not be responsible for any damages due to delays in shipping.

Charges for shipping will be listed when you purchase the product from this website. You are responsible for all federal and national shipping related taxes, and you agree to comply will all export laws of Ecuador that apply to the products purchased or received under this Agreement.

HERBOLARIUM uses DHL, EMS POST SERVICES (USA - EUROPE), SERVIENTREGA, TRAMACO (ECUADOR) and other couriers as shipping services providers to ship its products. As such, HERBOLARIUM will not be liable for any loss, damages (direct or indirect) or expense due to shipping. Title and risk of loss shall pass to you at the moment the product that you have purchased is transferred to the third party shipping service provider.
 

e) Return & Refund Policy:

 

If any of our products do not meet your expectations, we want to know. As such, please email elherbolarium@gmail.com and please include your order number and a description of the reason for the return. We will gladly exchange or refund your purchase within thirty (30) days of receipt of the returned merchandise. 

 

Please note that items returned from the USA, Europe, are ineligible for a full refund of duty or taxes from your local customs office if, when purchased, import fees were due upon delivery. 100% Refund will be only applied in Ecuador.

• Final Sale Policy: all sale items purchased at an extra 10% off are final sales and cannot be returned or exchanged.

 

f) Cancellations

As soon as we receive your order, we start working on it right away. While we’re unable to make changes after you've placed your order, you do have a short window of time to cancel items from your order before they begin processing. Please note, only items eligible for cancellation will be shown, and all quantities of the selected item will be cancelled. If you do not see the “Cancel Items” option in the order details, that indicates that we are unable to process a cancellation. However, once you have received your order, you may return or exchange any eligible items. A made-to-order purchase is ineligible for cancellation.

Once your items are successfully cancelled, you will receive an email that includes the cancellation details. The email will be sent to the address listed on the order. You will not be charged for any cancelled merchandise.

g) Miscellaneous

This website, any use of this website and any dispute relating thereto to or to the products purchased therein shall be governed and construed by the laws applicable in Ecuador, without regard to conflict of law rules. Both HERBOLARIUM and you agree to the exclusive jurisdiction of the Republic of Ecuador, South America.

h) Disclaimer

Actual product packaging and materials may contain more and/or different information than that shown on our Website. We recommend that you do not solely rely on the information presented and that you always read labels, warnings, and directions before using or consuming a product. For additional information about our products, please contact us at elherbolarium@gmail.com. You should not use this information as self-diagnosis or for treating a skin problem or disease. Contact your healthcare provider immediately if you suspect that you have a medical problem.

All products are produced in Ecuador.

This Agreement and the Privacy Policy shall constitute the entire agreement between the parties and there are no other written or verbal agreements or representations relating to the subject matters described herein.

Should any provision of this Terms of Use be deemed invalid or unenforceable, those provisions shall be severed from the Agreement, but shall not effect the validity of the other provisions.
